Myth No. 1: A Stay-At-Home Spouse Cannot Afford A Divorce

If you are a stay-out-home spouse, you may not think you can afford a divorce, even though your husband or wife is a high earner. Perhaps you have been out of the workforce and have given up many career opportunities to support your spouse.

Spousal support/alimony exists as a remedy in these circumstances and can provide a bridge. Temporary support may also be available to help maintain the same standard of living during the divorce process.

Myth No. 2: Marital Misconduct Can Preclude You From Child Support

While it is true that the court can consider an affair or other misconduct when deciding on alimony, such instances cannot impact child support determinations. Marital misconduct is also immaterial to property distribution.

Myth No. 3: A Divorce Will Cost You Your Business

If you own a business — particularly if your spouse is involved in its operation — divorce can be a uniquely complicated endeavor. When a business is considered marital property, your spouse will have an interest, but liquidation is not the only means of arriving at a settlement.

You may be able to negotiate a buyout or retention stake in the business. If you had a prenuptial agreement, it may provide a road map and reduce conflict.

It’s commonly thought that the divorce process is long and expensive.
